Overview
The following terms constitute an agreement between you ("Customer") and TailoredVPS.com ("Tailored VPS"). These Terms of Service ("Agreement") govern your use of the services provided by Tailored VPS (the "Services"). Clients will be held responsible for any and all actions performed by their account whether done by the account holder or by others.
Tailored VPS reserves the right to modify, ammend, and update Agreement at anytime. It is the responsibility of Customer to periodically check for changes.
Prohibited Content
Services provided by Tailored VPS may only be used for lawful purposes. Tailored VPS is not responsible for the actions of Customer while using our Services. Content prohibited on Tailored VPS' servers includes, but not limited to:
If Customer is found hosting listed prohibited content on Services provided by Tailored VPS, a supervisor will deem the appropriate consequence. Whether it be suspension or termination of Services.
14 Day Refund Policy
Tailored VPS agrees to provide Customer with a full refund if a refund is requested within the 14 days after Customer orders Services. All payments after the first 14 days and licenses (Control Panels) are deemed unrefundable. If Customer breaks this Agreement, Customer is no longer eligible for a refund from Tailored VPS.
Suspension/Termination
A suspension occurs when this Agreement is broken by Customer. If Services are suspended Customer has 7 days to resolve the issue, unless otherwise stated. If customer fails to resolve issue within the allotted time, Tailored VPS reserves the right to terminate Services if deemed necessary by a supervisor. An unsuspension fee of $15.00 may be issued if Tailored VPS deems necessary.
Tailored VPS agrees to not immediately terminate Services and to give Customer at least 24 hours to resolve an issue.
Abuse Fees
Customer is responsible for all abuse fees, including but not limited to: spam fees, billed to Tailored VPS due to abuse caused by Customer. Services will remain suspended unless fees are paid for. If Customer is unable to pay for the abuse fees, it is Customer's responsibility to contact Tailored VPS to have the abuse fee waived.
Server Abuse
If Customer causes issues with Tailored VPS' servers, including but not limited to: downtime or resource hogging, Services may be suspended at Tailored VPS' discretion.
Price Changes
Customer's invoice price is locked and will not change unless Customer upgrades/downgrades the Services.
Scheduled Downtime
Tailored VPS agrees to give Customer at least 24 hours notice for scheduled downtime. Scheduled downtime is not applicable to Tailored VPS' Service Level Agreement. If Tailored VPS does not provide 24 hours notice, Customer may claim Service Level Agreement for the downtime.
Backups
Customer is fully responsible to regularly make backups of Services. While Tailored VPS' servers are protected by RAID, Tailored VPS takes nov liability for any lost data.
Disclosure to Law Enforcement
Tailored VPS will disclose Customer information to law enforcement agencies if an approved court order or warrant has been provided. Tailored VPS will fully cooperate with local, state, and federal law enforcement agencies.
